Terms and Conditions Harvey Maria Ltd. aims to provide a personal, professional and friendly service. We also believe in plain speaking and our Terms & Conditions follow, in logical sections to aid readability. Please read them carefully. A condition of placing an order with us is that you confirm you have read, understood and agree to them. Account customers are subject to Harvey Maria standard Conditions of Sale which are accepted by all trade customers when opening an account and are available separately on request.
About Us Harvey Maria Ltd. (hereafter referred to as Harvey Maria) a limited liability company registered in the United Kingdom. Our registered office is Acorn House, 74-94 Cherry Orchard Rd. Croydon, Surrey CRO 6BA which is not a showroom or warehouse and is not open to the public unless by prior appointment. Harvey Maria has designed and sold original floors since 1994 and on-line since 1999.
How to buy from our website As you browse around our site you will see “Buy” buttons which enable you to add products to your shopping basket. Feel free to use this as a virtual shopping list, as you can just as easily remove them at any time, and adjust quantities up or down too.
You can view the contents of your cart at any time using the “Shopping Basket” option on the menu at the top of the site. To place your order, click the “Checkout” button, at which point we will ask you for some address details and take your card payment online.
The "Tile Calculator" provides an approximation of the number of packs that you will require based on the room measurements that you enter. The approximation includes an allowance of 7.5% to take account for the wastage from cutting during the fitting process for a normal room. If the installation is likely to involve cutting unusual or intricate shapes then more wastege is likely and you may wish to order additional flooring than is suggested by the tile calculator. If you require any further information on calculating the number of packs required please contact us with your room measurement details.
We will credit the amount you spend on large samples up to £10 against your subsequent full order for flooring over £150. Order your flooring via our website in the usual manner and the credit will be applied when we process your order.
Product Information The prices shown are subject to an additional shipping cost which is estimated on the shopping basket page according to the weight and size of your total order and which is calculated at the checkout with reference to your geographical location.
Please note that any levies/taxes charged for international shipments are not calculated or monitored by Harvey Maria and are therefore not the responsibility of Harvey Maria. We recommend that customers requiring delivery outside of the UK should check with their local customs officials or post office for more information. Harvey Maria Limited is VAT Registered. Please note that lighting can affect the perceived colours of images in photographs and that colours can be displayed differently from one computer monitor to another. Colours of products seen on the web site or in a brochure may therefore vary from the actual product. Some of the images may be computer generated to simulate the appearance of floors in actual rooms.
Samples have been cut from an overall design, therefore decoration and shade may vary. Samples may be slight seconds and should not be used for flooring purposes. Use of samples for flooring purposes will invalidate the warranty of your entire floor.
The random nature of the patterns from which some of our designs are taken means that some colour and design variation is normal. There is no pattern match from tile to tile for any Harvey Maria floors. Always supply your batch number when re-ordering to match an original floor and we will endeavour to supply from the original batch if available as there may be slight colour variation from batch to batch.
Paying for your Order We accept credit or debit card payments with cards including Visa, Mastercard, Maestro, Electron, Switch, JCB and Solo. We can also accept orders by mail. Please send your order details together with a cheque (in pounds sterling) made payable to “Harvey Maria Ltd.” to our office address listed above. You should write your card number and expiry date on the reverse of the cheque, and please note that we cannot begin to process your order until the funds are cleared through our bank.
By purchasing from us, you confirm that the credit or debit card that is being used is yours and understand that all credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. All goods remain the property of Harvey Maria until paid for in full. In order to guard ourselves and our customers from fraud we deliver to the card holders address, which is assumed to be the one you give at the beginning of the order process as the customer's address. If there is a discrepancy between this and the cardholders address we will contact the cardholder for confirmation prior to processing the order.
How safe are your personal details during checkout? Your confidential information is protected in transit from your computer during checkout using the Secure Sockets Layer (SSL) protocol with an encryption key length of 128 bits - the highest commercially available. We use the services of third party company “Secpay” to perform the actual card transaction and only Secpay and the acquiring bank shall have access to your card details. For further information please read the section on our Privacy Policy below.
Delivering your Order We endeavour to deliver received orders within 3 working days within the UK and 7-10 days for overseas delivery (subject to customs clearance) where the good(s) are in stock, though you should allow up to 28 days for delivery of your order. All delivery dates are estimates only and cannot be guaranteed and we cannot accept any liability for any direct or indirect loss or damage resulting from delivery outside of these estimated timescales. We will, however, endeavour to keep you informed of any such delays.
Orders for sample products are delivered via the Royal Mail standard postal service. All other deliveries shall take place via a Carrier appointed by Harvey Maria and/or its agents and shall be a weekday delivery to your door between 08.00 and 18.00.
Carrier deliveries require a signature. Please inspect all goods immediately on delivery, this means glancing over (but not opening) packs of flooring for visible damage. You or the person acting on your behalf should document any transit damage at that time on the delivery note. If the Carrier is unable to obtain the required signature for an arranged delivery then they will attempt a re-delivery or you may be required to collect your order from the Carrier’s nearest depot or else you may be liable for redelivery charges. You may choose at the time of ordering to have the delivery left in another place specified by you but Harvey Maria cannot be responsible for any transit damage or for any subsequent loss or theft of the goods if you have chosen not to sign for your delivery.
Flooring deliveries could be made on a truck or a van. It is assumed that the delivery address will be accessible. If there is likely to be a problem, e.g. the road is subject to a vehicle weight or width restriction, please inform us at the time of order. While we endeavour to deliver to the majority of the United Kingdom and most overseas countries, we reserve the right to refuse your order should our Carrier not be able to deliver to your location or if our estimated cost of carriage is more than the delivery charge itemised on your order.
Acceptance and Refusal of your Order To be eligible to purchase goods on this web site and lawfully enter into and form contracts on this website under English law you must be over 18 years of age, provide your real name, phone number, e-mail address, payment details and other requested information, and stipulate a delivery address. Please note that PO box numbers, hotels and accommodation addresses are not acceptable.
We reserve the right to withdraw any products from this web site at any time and/or remove or edit any materials or content on this web site. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this web site whether or not that product has been sold; removing or editing any materials or content on the web site; refusing to process a transaction or unwinding or suspending any transaction after processing has begun. Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the Products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions set out in these Terms & Conditions.
In the unlikely event that the goods you order are no longer available, we will offer you the choice of an alternative product, credit to the value of the goods or refund to the value of the goods.
Returns Policy We hope that you will be happy with your purchase from us. We will accept whole orders returned to us for any reason within 14 days of receipt. The goods should be returned in undamaged condition and in original unopened packaging . We will process a refund within 28 days of receipt. The original costs incurred by Harvey Maria of shipping your order are not refundable. Harvey Maria does not accept returns of part orders.
If you are unfortunate enough to receive a damaged item or an item is missing, make sure it is noted on the carrier’s paperwork. No claims for damaged or missing items can be made after the carrier has left the delivery address, unless signed for as damaged or missing.
In the event that the goods you order from Harvey Maria are faulty you shall have three days from receipt of the goods in which to notify us. Upon notification we will arrange with you for the goods to be inspected or will request that you return them to us.
You must notify Harvey Maria of your request to return goods for any reason by emailing us at info@harveymaria.co.uk or by writing to us at the office address listed above. Returned goods require a 'Return Tracking Number' issued by Harvey Maria which must be returned together with the goods. The buyer assumes the cost of returning goods to Harvey Maria, unless otherwise agreed. Your statutory rights as a consumer remain unaffected.
Check that all flooring products are flawless before laying them. Harvey Maria will not accept any claims for damaged, faulty or mis-described items once the flooring has been installed. Where the buyer or his agent has used or installed the goods such use or installation shall be taken as conclusive evidence that the buyer has accepted that the goods are in perfect condition. You must accept full responsibility for the suitability of the goods ordered for the purpose to which they are put. We comply fully with the Consumer Protection Regulations 2000 (“Distance Selling Act”)

Complaints Procedure In the unlikely event that you have a complaint concerning an order through Harvey Maria you should either email us at info@harveymaria.co.uk, write to us at our office address listed above or telephone us on our local rate telephone number 0845 680 1231 between 09.00 and 17.00 hours, Monday to Friday. A senior manager will personally deal with your complaint and you will be kept informed during all stages of the complaints procedure. We will endeavour to respond to your complaint within three working days of receipt.
Privacy Policy We will treat all your Personal Information as confidential. We will keep it on a secure server and we will fully comply with the Data Protection Act 1998 and applicable consumer legislation from time to time in place. When you shop with us on our web site, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, billing address, delivery address, telephone number, product selections, credit card or other payment information. We use a third party company “Secpay” for this purpose of the card transaction and only Secpay and the acquiring bank shall have access to your card details. We may also collect information about where you are on the internet (eg. the URL you came from, IP address, domain types like .co.uk and .com), your browser type, the pages of our website that were viewed during your visit. We may collect this information even if you do not register with us. You should be aware that this site is being monitored and may capture information about your visit that will help us improve the quality of our service.

Warranties Harvey Maria will furnish replacement flooring free of charge if there is a loss of original pattern and colour under normal residential and/or commercial use of Harvey Maria flooring for the number of years as indicated below provided the flooring covered by this warranty is installed and maintained according to our instructions available at www.harveymaria.co.uk. This warranty does not include damage due to improper installation or maintenance, excessive moisture or alkalis in the subfloor or conditions arising from hydrostatic pressure, burns, tears, indentations, stains or reduction in gloss due to normal use or exterior application. This warranty shall not include loss of time, inconvenience, incidental expenses incurred in the removal or reinstallation of the affected material and any other incidental or consequential damages. This warranty is in lieu of any other warranties, expressed or implied. The warranty service is only available by notice to Harvey Maria. Notification must be accompanied by a copy of the original invoice. Lifestyle & Simply Stone: 10 year domestic usage warranty; 5 year commercial usage warranty. All other ranges: 15 year domestic usage warranty; 10 year commercial usage warranty.
Liability Save for liability for death or personal injury due to the negligence of Harvey Maria and liability under the Consumer Protection Act 1987, Harvey Maria’s total liability to the Customer under these Conditions (whether in contract, tort (including negligence) or otherwise) shall not in any circumstances exceed the price paid by the Customer to Harvey Maria in respect of the Products and/or Services in question in respect of any one incident or series of incidents attributable to the same cause.
Harvey Maria shall not be liable for any special, indirect or consequential loss or damage whatsoever (whether caused by the negligence of Harvey Maria or otherwise) which arises out of or in connection with the supply of the Products or their use or resale by the Customer.
Harvey Maria shall not be liable to the Customer (including but without limitation in negligence) or be deemed to be in breach of contract by reason of any delay in performing, or any failure to perform, any of Harvey Maria’s obligations in relation to the Products and/or Services, if the delay or failure was due to any cause beyond Harvey Maria’s reasonable control.
Governing Law This contract between us shall be governed by and interpreted in accordance the laws of England and the English courts shall have jurisdiction to resolve any disputes between us. The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.
